These Terms of Service govern your use of promogator.com and the purchase of custom promotional products from GATOR INC. ("Promogator", "we", "us"). By placing an order or using the site you agree to these terms.

Orders and estimates

All orders are for custom-decorated products and are produced to your specifications. An order is accepted when we send an order confirmation. Estimates and purchase orders are valid for the period stated on the estimate.

Artwork and proofs

You are responsible for the artwork you supply and confirm that you have the right to use any logos, trademarks or images in it. Production begins only after you approve the electronic proof; please review proofs carefully — we are not responsible for errors approved on a proof.

Payment

Payment is due as stated on your order or invoice. Orders placed on terms must be paid by the invoice due date. We may place an order on hold until payment is received.

Production and shipping

Production and in-hands dates are estimates. Shipping charges, carrier selection and delivery times are as shown on your order. Risk of loss passes to you when the carrier accepts the shipment.

Cancellations, returns and claims

Because products are custom made, orders cannot be cancelled or returned once production has started, except for defects or errors on our part. Please report any problem with your order within 7 days of delivery so we can make it right.

Text messages and WhatsApp

If you choose to receive them, Promogator sends order updates by text message (SMS) and WhatsApp to the mobile number you give us. These updates include proofs, artwork, production, shipping and delivery, invoices and payment receipts. You can also chat with our team and our order assistant on WhatsApp at +1 714-383-9866. How many messages you get depends on your orders. Message and data rates may apply. To stop, reply STOP to any message, or turn these messages off any time in My Account → Settings → Notifications & WhatsApp. For help, reply HELP or email info@promogator.com. Agreeing to receive messages is not a condition of purchase. We still send order confirmations, invoices and receipts by email. Carriers are not liable for delayed or undelivered messages.

Limitation of liability

Our liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential damages.
